First Iowa DUI:

Imprisonment: 48 hours - 1 year

Court can defer judgment or sentence or suspend sentence unless:
- Record shows 1 or more OWI related license revocation within the past 12 years,
- Defendant's BAC was .15% or greater,
- Defendant has previously received a deferred judgment or sentence,
- Defendant refused a chemical test, or
- the OWI offense resulted in bodily injury to a person other than the defendant

Court can defer judgment or sentence or suspend sentence unless:
- Fine: Up to $1,250
- Substance Abuse Screening and Treatment: Required
- Driver's License Revocation: 180 days (90 days with deferred judgment). Temporary restricted license available immediately if no aggravating factors are present
Second Iowa DUI:
- Imprisonment: Mandatory minimum 7 days (not suspendible) - 2 years
- Fine: $1,875 - $6,250
- Substance Abuse Screening and Treatment: Required
- Vehicle Immobilization: Minimum 180 days or until driver's license revocation completed
- Driver's License Revocation: 1 year. Not eligible for temporary restricted license for 45 days
Third Iowa DUI (Class D Felony):
- Imprisonment: Mandatory minimum 30 days - 5 years
- Fine: $3,125 - $9,375
- Substance Abuse Screening and Treatment: Required
- Vehicle Immobilization: Minimum 180 days or until driver's license revocation completed
- Driver's License Revocation: 6 years. May apply for temporary restricted license after one year if ignition interlock device installed in vehicle.
